The fee for our services is earned if a candidate is hired full time, contract or any other way, directly, or indirectly, by the employer, its divisions, subsidiaries or affiliates, within one year of our referral. The fee is also earned in the event the employer refers the candidate to another search firm, agency or employer who hires the candidate.
Fee: Our fee is 35% of the candidate's first year's starting compensation, which includes salary and starting bonuses.
Payment and Referral: Payments are due within ten (10) calendar days of the candidates start date. Any invoice unpaid after thirty (30) will be considered past due. All past due unpaid sums shall bear interest at the rate of 1% per month. Your acceptance of referrals constitutes your agreement with our fee schedule. A referral is any written or verbal presentation of the candidate's qualifications or employment history.
Venue and Jurisdiction:Any dispute or claim brought pursuant to this Agreement must be brought in a Court of competent jurisdiction in Houston, Harris County, Texas and the parties consent to such exclusive jurisdiction and venue. In the event that JDA Professional Services, Inc. secures the services of an attorney to enforce any of the terms and conditions of this Agreement, it shall be entitled to recover reasonable attorney’s fees.
